Terms and conditions of the health check service

Registration for health check is offered by the Liikluslab group of companies, which includes Liikluslab Baltic OÜ (registry code 14812701) and Liikluslab Tervis OÜ (registry code 12190856), located at Rotermanni 18/1-301, Tallinn, e-mail info@liikluslab.ee (hereinafter referred to as Liikluslab or us).

General Information

Liikluslab offers you the opportunity to undergo a health check and obtain a driver's health certificate at the Liikluslab Tervis OÜ clinic (the number of medical licence L07248) or its partner clinics. Registration and payment is done on the websites liikluslab.ee or tervisetõend.ee, and the health check is carried out by the Liikluslab Tervis OÜ clinic or an authorised occupational health institution who has respective contract with Liikluslab (partner clinic). Upon the client's request, Liikluslab can forward the driver's health certificate group (either I or II) and the date of issue to the driving school of the client's choice, which is a partner of Liikluslab (read more about consent in the next section). In order to register for a health check, you must agree to these terms and conditions of the health check service (hereinafter referred to as the "Terms of Service"), by ticking the box "I accept the terms of service". The contract between us is deemed to be concluded from the moment you accept the Terms of Service and make the payment.

The Terms of Service will remain available to you on the websites liikluslab.ee or tervisetõend.ee, and in the e-mail we send to you to confirm your booking for the health check.

Registration for the Health Check and Payment

You can register for a health check on the websites liikluslab.ee or tervisetõend.ee by choosing a suitable place, date and time and paying for the service. We will confirm receipt of the fee by sending you an invoice by e-mail. The price list can be found on the websites liikluslab.ee or tervisetõend.ee.

Registration for a health check starts with the selection of the place and time. The time you choose for the health check will be reserved in the system for 15 minutes to allow you to complete the registration process and to avoid someone else choosing the same time. During this time, you will need to confirm your e-mail address or log in to your Liikluslab account, enter your name, personal identification number, telephone number and other necessary details and make the payment. Liikluslab will confirm the successful booking of the health check by e-mail.

If the booking of the medical check is successful, you can choose to consent to the transfer of the group and date of issue of the health certificate to Liikluslab and its partner driving school. During the health check, the occupational health professional will ask you to confirm your choice and clarify whether your consent is valid. You can withdraw your consent at the time of the health check or by clicking on the link in the e-mail you will receive after booking your appointment.

A third person (e.g. a family member or colleague) can also be registered for a health check. In any case, it is important that the person who is registered for the health check attends it - you cannot transfer your health check appointment to another person.

By registering for and paying for a health check, you agree and acknowledge that:

  • the service consists of a health check and the completion of the health check does not guarantee the issuance of a certificate to drive a motor vehicle; if the person is referred for a re-check, the re-check will be subject to a separate fee
  • completion of the e-health declaration prior to the appointment at the Liikluslab Tervis OÜ clinic or at a partner clinic is a mandatory prerequisite for the health check and it is not possible to complete the e-health declaration on the spot; if the e-health declaration is not completed prior to the appointment, the health check will not take place and the health check fee will not be refunded
  • an identity document is a compulsory prerequisite for the health check; if the person does not have such a document with him/her, the health check will not take place and the health check fee will not be refunded
  • if you are late for the health check, the health check will not take place and the fee will not be refunded; if you do not attend the health check, the health check fee will also not be refunded
  • the time of the health check can only be changed once by informing the Liikluslab no later than 48 hours before the appointment at the clinic.

Health Check

The health check is carried out by the Liikluslab Tervis OÜ clinic or by a partner clinic to check that your state of health meets the health requirements for driving a motor vehicle. These requirements are set out in Government Regulation No 80. The service is a medical check (not the issuing of a medical certificate). If your state of health allows you to drive a motor vehicle of the relevant category, you will be issued with a health certificate for motor vehicle drivers.

At the Liikluslab Tervis OÜ clinic, you will be seen by a nurse who will conduct an interview and carry out the necessary procedures. The doctor will review the data collected by the nurse, along with your electronic health declaration, and based on this information will decide whether to issue a health certificate for driving. This is a responsible decision, and depending on your state of health and the availability of your medical history, the doctor may issue a medical certificate for a shorter period than permitted by law (for example, the medical certificate may be valid for 5 years instead of 10).

During the health check, you will be asked to give consent for the decision to be sent to the email address you provided when booking the appointment. If you give your consent, you will receive an email indicating whether the medical certificate has been issued or not. If you do not give consent, you can view the decision in the Patient Portal. If the certificate is issued, it will become immediately visible in the self-service section of the health portal (www.terviseportaal.ee). If the certificate is not issued, you will be able to see the reason for the decision in the portal, as well as the next steps (e.g. the need to consult a specialist for further evaluation).

The health check starts with the identification of the person using an ID card or passport. It is important that the person who has registered for the health check attends it - it is not possible to give up your time to other people. If a third person who has not registered for the health check attends, there will be no appointment and the health check fee will not be refunded.

At your request and with your consent, the group and date of issue of the health certificate will be forwarded to the driving school, which is a partner of Liikluslab. In this case, the occupational health professional will pass this information on to the Liikluslab and Liikluslab will pass it on to the driving school of your choice. The driving school needs the information on the health certificate in order to comply with the requirements of MKM Regulation No 60, § 29 (to be admitted to a training course, a person must hold a valid health certificate with a sign authorising him/her to drive a motor vehicle of the category applied for). You can withdraw your consent to the transfer of the group and date of issue of the health certificate to the Liikluslab and the driving school at the time of the health check or by clicking on the corresponding link in the e-mail you received to confirm the appointment booking.

If an occupational health professional has doubts about whether your state of health meets the health requirements for driving a motor vehicle, you will be referred to a specialist for further tests and invited for a re-check. In this case, the fee paid for the health check will not be refunded. If the issue of a medical certificate is conditional on a visit to a specialist, additional tests or other procedures, you will have to arrange these yourself at your own expense. The Liikluslab Tervis OÜ clinic and its partner clinics do not issue referral letters.

At your request and with your consent, it will be noted in the Liikluslab information system that you have been assigned a re-check (the reason and health-related information will not be noted). This information will be used by Liikluslab to offer you a discount on the price of a re-check. If it is not noted in the Liikluslab information system that you are coming for a re-check, then Liikluslab does not have this information and we cannot offer you a discount. You can cancel your consent by clicking on the link in the e-mail we will send you after the health check.

You must not eat or drink anything (except water) for three hours before your appointment, otherwise a blood test cannot be performed and the health check will not take place.

If the health check reveals that you have medical contra-indications which preclude the issue of a health certificate for motor vehicle drivers, you will not be issued with a health certificate. In all the five cases listed above the fee paid for the health check will not be refunded.

Mandatory Prerequisites for the Health Check

Completion of an eHealth declaration before the start of the health check is a mandatory prerequisite for the health check. In the case of minors, the e-health declaration must be completed by the parent or guardian. It is not possible to fill in the eHealth declaration on the spot. If the eHealth declaration is not completed before the start of the appointment, the health check will not take place.

An identity document is also compulsory as a prerequisite for the health check. If you do not have such a document with you, the health worker will not be able to identify you and the health check will not take place.

If you use glasses/contact lenses, prostheses or similar aids, you must take them with you to the health check. If you do not have them with you at the time of the health check, the occupational health professional will not be able to conduct the health check and the health check will not take place.

If you have blocked access to your health data (including your eHealth declaration) for health professionals, an occupational health professional will not be able to check whether your health meets the health requirements for driving a motor vehicle and there will be no health check.

In all four of the above cases, the fee for the health check will not be refunded.

Changing the Time of a Health Check, Being Late or not Turning up for a Health Check

You can change the time booked for your health check at least 48 hours before your appointment by sending your request to info@liikluslab.ee. Liikluslab will contact you and offer you a new appointment time. You can only change your appointment time once.

You cannot transfer your health check appointment to another person, which means that you cannot change the identity (name and personal identification number) of the person registered for the health check. If a third person takes your place, the health check will not take place and the fee paid will not be refunded.

You can change your contact phone number and the health certificate group you are applying for at any time, but no later than 30 minutes before the start of the health check. To do this, you can use the corresponding link (included in the e-mail that you will receive from Liikluslab to confirm your booking).

If you are late, the health check will not take place and the fee will not be refunded. Therefore, we kindly ask you to arrive 10 minutes before the start of the health check.

If you do not show up for the health check, the fee paid for the health check will not be refunded.

Liikluslab and Customer Rights and Obligations

Given that by agreeing to the terms of the service (and thereafter paying the fee), the client will have access to the health check services (i.e. Liikluslab has fulfilled its obligation on the client's behalf), the client will not be entitled to cancel the health check appointment or claim a refund of the fee paid for it. By accepting the terms and conditions of the service, the client confirms that he/she has no right to withdraw from the contract once Liikluslab has fulfilled its obligations.

If the health check does not take place because of the Liikluslab Tervis OÜ clinic or a partner clinic, Liikluslab will offer you a choice of new health check times. If none of the offered times is suitable for you, Liikluslab will refund the health check fee in full at the earliest opportunity, depending on the payment method used by the client, but no later than within 10 days.

Liikluslab has the right to unilaterally modify the terms and conditions of the service if this is necessary as a result of the services provided by Liikluslab, legislation or case law. The modified terms and conditions of service shall enter into force at the moment of their publication on the websites liikluslab.ee or tervisetõend.ee.

Liability

Liikluslab is not liable for any delays, failures or interruptions in the use of the websites liikluslab.ee or tervisetõend.ee caused by circumstances beyond the control of Liikluslab, including force majeure, power failures, failures in the Internet connection of the client or of Liikluslab or the operation of other electronic equipment and devices (including software).

Liikluslab is not liable:

  • for any technical problems with the liikluslab.ee or tervisetõend.ee websites or for any damage that may arise as a result;
  • for the consequences of spam e-mails sent to the client, the blocking of e-mails (including the unsubscribe function and the overflowing of e-mail box);
  • problems related to using an outdated version of the browser or an infrequently used browser;
  • any damage suffered by the client as a result of breaching these terms of service;
  • for any damage suffered by the client as a result of the exercise by Liikluslab of any of the rights or remedies described in its terms of service.

In the event of a breach of the agreement by Liikluslab, the user is entitled to use all available legal remedies. In the event of any liability, the extent of the liability of Liikluslab to the customer is limited to the amount of the sale price of the service purchased.

The health check is carried out by and is the responsibility of the Liikluslab Tervis OÜ clinic or a partner clinic.

Applicable Law and Disagreements

The Terms of Use are governed by Estonian law.

Disputes relating to the Terms of Use shall be settled by negotiation. If the parties fail to reach an agreement, the User shall have the right to refer the matter to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority or to the competent court, and Liikluslab to the competent court.

The user may submit complaints about the services without delay, but no later than two weeks after the complaint arises. In this case, the complaint must be sent to info@liikluslab.ee.
